Access to Justice

Access to Justice in a Multilevel European Constitutional System is an Erasmus+ Action Jean Monnet Module, funded by the EU Commission, aiming to foster the study of access to justice in the European multilevel and multilayered framework, under a constitutional and comparative perspective.

Access to justice examined from a constitutional point of view in the global context of sustainable development takes on unprecedented connotations that exacerbate the tension between courts and legislators at national and supranational level. From the perspective of the protection of fundamental rights, it reveals its dual nature as a fundamental right itself and as an instrument for the protection of fundamental rights, the scope of which can well be defined starting from the approaches reached by the jurisprudence of the European Courts and the National Highest Courts, given the mutual influence they have exercised and continue to exercise.

On the 17th and 19th of May we hosted the final simulation of the Moot Court of Constitutional Law at the University of Milan. After months of preparation and the exchange of memoranda, finally the Private Party and the State groups pleaded in front of the Court group on a case on the constitutionality of Art. 4, c. 4 d.l. n. 44/2021 (“Urgent measures in the SARS epidemic”), as modified by d.l. 172/2021. Several national constitutional provisions, as well as supranational (CDFEU and ECHR), were considered by all the groups.

On the 17th of February we had the pleasure of hosting a series of Roundtables on the Italian class action regime, in a European perspective, with several practitioners and academics from different disciplines of law. It was a very thought-provoking and enriching discussion. Thanks to all the participants!
